These Terms of Service ("Terms") govern your access to and use of servdigital.io (the "Site"), operated by ServDigital.io, a trade name used by SERVDIGITAL IO LLC, a Massachusetts limited liability company ("ServDigital," "we," "us," or "our"). By using the Site, you agree to these Terms. If you don't agree, please don't use the Site.
The Site is intended for business owners, decision-makers, and their representatives researching or requesting our services — roofers, pressure washers, detailers, contractors, and similar service businesses. You must be at least 18 years old, and authorized to act on behalf of any business you represent, to use the Site.
The Site is an informational and marketing website describing ServDigital.io's services — website design and hosting, missed-call text-back automation, review request and reputation management, CRM and pipeline setup, AI-assisted Google Business Profile management, and related services — and a way to request a free quote or demo.
These Terms do not, by themselves, create a contract for paid services. If you decide to become a client, that engagement is governed by a separate, signed Client Service Agreement, which controls over anything on the Site in the event of a conflict. Nothing on the Site is an offer to contract on the terms described here.
When you submit the Free Quote form, you agree to provide accurate information and to only submit inquiries on behalf of yourself or a business you're authorized to represent. Submitting the form doesn't obligate you to purchase anything, and doesn't obligate us to provide services until we've agreed on a plan and signed a Client Service Agreement.
By submitting the form, you agree that ServDigital.io may contact you by phone, text, and email about your inquiry, as described in our Privacy Policy, including its section on SMS/text messaging consent.
If you provide your mobile phone number and opt in through the form's SMS consent checkboxes, you agree that ServDigital.io may send you text messages about your inquiry and, if you become a client, about the services we provide you (for example, appointment reminders, follow-up questions, and account or service updates). Messages may be sent using automated technology.
The chat widget is an automated tool intended to answer general questions about our services. It is provided for informational convenience only, its responses are not guaranteed to be accurate or complete, and it is not a substitute for speaking with us directly about your specific situation. Don't rely on the chat widget as professional, legal, or financial advice, and don't submit sensitive personal information through it.
Nothing on the Site — including example results, descriptions of our process, or statements about typical outcomes — is a guarantee of any specific result for your business. Results from our services depend on many factors outside our control, including search engine and platform algorithm changes, market conditions, competition, and your own responsiveness. Any case studies, statistics, or examples on the Site are illustrative, not a promise of similar results.
The Site, including its text, design, graphics, logos, and the ServDigital.io name and branding, is owned by ServDigital.io or its licensors and is protected by copyright, trademark, and other laws. You may view and share pages of the Site for your own evaluation of our services. You may not copy, reproduce, republish, scrape, or create derivative works from the Site's content for commercial purposes without our prior written permission.
You agree not to:
The Site may reference or link to third-party services (for example, Google Business Profile or Google Search). We don't control those third parties and aren't responsible for their content, practices, or availability. Your use of any third-party service is governed by that provider's own terms.
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SERVDIGITAL.IO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).
This limitation does not apply to paid services performed under a signed Client Service Agreement, which has its own limitation of liability section.
You agree to indemnify and hold ServDigital.io harmless from any third-party claims, damages, and reasonable attorneys' fees arising out of your misuse of the Site or violation of these Terms.
If you engage ServDigital.io for paid services, your Client Service Agreement governs that engagement, including fees, term, deliverables, warranties, and liability for the services themselves. These Terms continue to apply to your use of the Site itself (browsing, the chat widget, future quote requests) alongside that agreement. If a provision of these Terms conflicts with your signed Client Service Agreement regarding the paid services, the Client Service Agreement controls.
We may update these Terms from time to time. If we make material changes, we'll update the "Effective Date" above and post the revised Terms on the Site. Your continued use of the Site after a change means you accept the updated Terms.
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws principles. You and ServDigital.io consent to the exclusive jurisdiction and venue of the state and federal courts located in Essex County, Massachusetts for any dispute arising out of or relating to these Terms or the Site.
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
